Welcome to DiveGigs. These Terms of Service ("Terms") govern your access to and use of divegigs.com and any related websites, features, communications, products, and services we provide (collectively, the "Services").

By accessing or using DiveGigs, you agree to these Terms. If you do not agree, do not use the Services.

1. Who may use DiveGigs

You may use DiveGigs only if you can form a legally binding agreement with us and comply with these Terms and all applicable laws.

If you use DiveGigs on behalf of a business, employer, or other organisation, you represent that you have authority to bind that entity to these Terms.

2. About DiveGigs

DiveGigs is an online job board and hiring platform focused on scuba diving and related roles. We provide a platform for employers to post opportunities and for candidates to discover roles, create profiles, and apply.

We do not employ candidates, guarantee job placement, guarantee applicant quality, or guarantee a listing will result in a hire.

We are not a party to any employment, contractor, internship, training, or other arrangement between users unless expressly stated otherwise.

3. Accounts

You may need to create an account to access some features.

You agree to:

  • provide accurate, current, and complete information
  • keep your login credentials secure
  • promptly update your information if it changes
  • accept responsibility for activity that occurs under your account

You must not share your account with others or impersonate any person or entity.

We may suspend or restrict accounts that appear insecure, misleading, fraudulent, abusive, or in breach of these Terms.

4. Candidate accounts and profiles

Candidates may create profiles, upload resumes or CVs, set job preferences, and apply for roles.

You are responsible for the accuracy of the information you provide, including qualifications, certifications, experience, visas, and availability.

You acknowledge that:

  • employers may view the materials you submit when you apply for a role
  • profile visibility and discoverability may depend on your account settings
  • you should not include sensitive or unnecessary personal information unless you are comfortable sharing it and it is relevant to your application

We do not verify every statement made in candidate profiles or applications.

5. Employer accounts and job listings

Employers may post listings and use DiveGigs to receive applications and manage recruiting activity.

By posting a job, you agree that:

  • the job opportunity is genuine, lawful, and accurately described
  • you have the right to advertise the role
  • the listing does not contain misleading, discriminatory, unlawful, deceptive, or offensive content
  • you will not collect, use, or retain candidate information except as reasonably necessary for legitimate recruitment purposes and in accordance with applicable privacy laws
  • you are solely responsible for your hiring decisions and communications with candidates

We may edit, reject, suspend, or remove listings that we believe breach these Terms, create risk, damage trust in the platform, or are otherwise unsuitable for DiveGigs.

6. Acceptable use

You agree not to:

  • use DiveGigs for any unlawful, misleading, fraudulent, or abusive purpose
  • scrape, harvest, copy, or systematically collect data from the Services without written permission
  • upload malware, malicious code, or harmful content
  • interfere with the operation, security, or integrity of the Services
  • bypass access controls or attempt unauthorised access
  • post false jobs, fake applications, spam, or scams
  • harass, threaten, or abuse other users
  • infringe another party's intellectual property, privacy, or other rights
  • use candidate information for marketing, spam, or unrelated commercial outreach
  • use the Services in a way that could damage DiveGigs, users, or the reputation of the platform

7. Payments, credits, and listing fees

Certain features of DiveGigs may require payment, including paid job listings or related upgrades.

All prices displayed on the Services are subject to change at any time before purchase.

Payments are processed by third-party payment providers such as Stripe. By making a purchase, you authorise the relevant payment provider to charge your chosen payment method.

Unless otherwise stated, fees are charged upfront and a listing or paid feature will generally become active once payment is successfully confirmed.

You are responsible for any applicable taxes, duties, or similar government charges associated with your purchase, other than taxes imposed on our income.

8. Refunds and finality of sales

Except as required by law, all sales are final. We do not provide refunds for change of mind, change in hiring plans, unused listings, dissatisfaction with applicant volume, or delays caused by incorrect information submitted by the purchaser.

However, nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under applicable law.

If a paid listing is materially defective because of an issue caused by DiveGigs, we may, at our discretion and subject to applicable law, provide an appropriate remedy such as correcting the issue, re-running the listing, issuing account credit, or providing a refund where required.

9. User content

You retain ownership of content you submit to DiveGigs, including profile information, resumes, job listings, images, text, and other materials ("User Content").

By submitting User Content, you grant DiveGigs a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, format, publish, display, and distribute that content as reasonably necessary to operate, improve, promote, and provide the Services.

You represent and warrant that:

  • you own or control the necessary rights in your User Content
  • your User Content does not infringe any third-party rights
  • your User Content is lawful and not misleading

We may remove or restrict User Content that we believe breaches these Terms or may expose us or others to risk.

10. Platform content and intellectual property

The Services, including the DiveGigs name, branding, website design, text, graphics, software, layouts, and platform features, are owned by or licensed to DiveGigs and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, reverse engineer, or otherwise exploit any part of the Services without prior written permission.

11. Third-party services and links

DiveGigs may contain links to third-party websites, services, or employer career pages. We may also rely on third-party providers to process payments, host infrastructure, or support functionality.

We do not control and are not responsible for third-party services, content, security, policies, or practices. Your use of third-party services is governed by their own terms and policies.

12. No guarantee of results

DiveGigs does not guarantee:

  • that any job listing will receive applications
  • that any candidate will be hired
  • that any employer will make an offer
  • that any role, employer, or candidate is legitimate, suitable, safe, or compatible
  • that the Services will be uninterrupted, error-free, or available at all times

Users are responsible for carrying out their own checks, due diligence, and judgment before relying on a listing, application, profile, or communication made through DiveGigs.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.

We do not make warranties or representations about the accuracy, completeness, reliability, availability, suitability, or fitness for purpose of the Services or any listing, profile, employer, candidate, communication, or content on the platform.

Nothing in these Terms excludes any non-excludable consumer guarantees, statutory rights, or other rights that cannot be excluded under applicable law.

14. Limitation of liability

To the maximum extent permitted by law:

  • DiveGigs is not liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage
  • DiveGigs is not liable for loss of profits, revenue, business opportunity, goodwill, anticipated savings, data, or reputation
  • DiveGigs is not liable for disputes, claims, losses, injuries, damages, or conduct arising between users, including between employers and candidates

Where liability cannot be excluded but can be limited, our liability is limited to the minimum extent permitted by law.

To the extent permitted by law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:

  • the amount you paid to DiveGigs in the 12 months before the event giving rise to the claim, or
  • AUD $100

15. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless DiveGigs from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use of the Services
  • your User Content
  • your breach of these Terms
  • your breach of any law or third-party right
  • your dealings or disputes with another user

16. Suspension and termination

We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably believe that:

  • you have breached these Terms
  • your conduct creates legal, security, reputational, or operational risk
  • we are required to do so by law
  • continuing to provide access is no longer commercially or technically feasible

You may stop using the Services at any time.

Any provisions of these Terms that by their nature should survive termination will survive, including provisions relating to payments, intellectual property, disclaimers, liability, indemnity, disputes, and general legal terms.

17. Changes to the Services or these Terms

We may modify, suspend, or discontinue any part of the Services at any time.

We may also update these Terms from time to time. When we do, we will post the updated version and update the "Last updated" date. By continuing to use the Services after updated Terms take effect, you agree to the revised Terms.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia, excluding its conflict of law rules.

You agree that courts located in New South Wales, Australia will have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except where mandatory law provides otherwise.
